LGBT Workplace Discrimination
With work being the primary activity of your day, it is vital that the environment that you work in is safe, secure, and free of any form of discrimination and harassment. Any type of discrimination or harassment in the workplace can not only infringe upon your personal comfort and safety, but it can also impede upon a positive workplace environment.
While it may seem that workplace discrimination is uncommon, it happens more often than most people think, and you might be in need of a Phoenix LGBT attorney.
One particular form of workplace discrimination that is seeing an upward trend is LGBT workplace discrimination.
While Arizona currently does not have any state-wide LGBT workplace discrimination laws in place, there has been progress to afford LGBT individuals the protections that they deserve.
In addition, while LGBT workplace discrimination may not go against Arizona laws, it may soon break protections afforded by the federal Employment Non-Discrimination Act, if passed.
Arizona Revised Statute 41-1463 and Proposition 475
While Arizona Revised Statute 41-1463 covers workplace discrimination based on race, color, religion, sex, age, or national origin, it does not afford individuals of LGBT affiliation protections.
However, that does not mean that progress has not been made.
The first formal move to ban workplace discrimination against lesbian, gay, bisexual, and transgender workers in the state of Arizona is Proposition 475.
Proposition 475, a charter by the City of Tempe, passed in late August of 2014. This proposition updates the city of Tempe’s charter to including prohibition of discrimination regarding race, gender, color, sexual orientation, religious, and U.S. military status.
Therefore, if you are a resident of Tempe and are facing workplace discrimination based upon your sexual orientation, then your employer may be violating legal protections.
Employment Non-Discrimination Act
The most recent federal move to ban workplace discrimination based upon LGBT affiliation is the Employment Non-Discrimination Act.
This act moves to protect those that work for private sector companies from discrimination in the workplace based on sexual orientation.
In 2013, the bill passed the Senate and it is still currently being considered.
While private sector employees are not afforded specific protections under the law, federal employees are protected by a recent executive order that bans workplace discrimination based upon sexual orientation or gender identity.
