New Law Now Allows Motorcycles to Pass Stopped Vehicles Between Lanes
In March 2022, Senate Bill 1273 was passed. Senate Bill 1273 will amend the following Statutes: Arizona Revised Statute §§ 28-729 and 28-903. The amendments will affect motorcycle operations and the bill will officially come into effect on September 24, 2022. Here is all you need to know about the new motorcycle law.
Post-amendment, A.R.S. § 28-903 will now allow motorcycles to overtake and pass stopped vehicle(s) between the lanes of traffic if it can be done safely. There are, however, a few requirements that must be met in order for the motorcycle to legally do so.
The vehicle(s) that is being passed must be traveling in the same direction and in the same lane as the motorcycle.
The street that the motorcycle is operating on must have at least two lanes in the same direction of travel.
The posted speed limit does not exceed forty-five miles per hour.
The motorcycle does not pass the stopped vehicles exceeding a speed of fifteen miles per hour.
While the bill will allow motorcycles to pass other stopped vehicles, it does not allow motorcycles to pass moving vehicles. Nonetheless, both automobile and motorcycle drivers should be aware of this new law.
